2024 Tribeca and Canva Creative Program Contest Rules & Regulations

GENERAL

Tribeca Film Festival NYC, LLC(“Festival”) and Canva Pty Ltd (“Canva”) are excited to announce the Kickstart with Canva Program (“Program”), created to help kickstart the further development of five (5) film projects. Festival and Canva will be hosting three (3) Program workshops from June 2024 to August 2024 (exact dates and times tbd) which will provide information and resources regarding entertainment industry advice and Canva tools. This contest provides the perfect opportunity for creatives to discover Canva’s design platform, and how it can be used to showcase their projects. Since submission of a project constitutes acceptance of these Entry Rules & Regulations (by you and your agents), please review this document carefully.

ELIGIBILITY

To be eligible for consideration:

  1. You must fully comply with these Entry Rules & Regulations, including all deadlines, entry material and other requirements.
  2. You have completed at least one project of any length within one of the following disciplines: writer, director, or producer.
  3. You are a US resident aged eighteen (18) or older at the time of submitting your entry.
  4. You must have attended at least two (2) sessions of the Program workshops.
  5. You must have an active Canva account (including Canva Free accounts but excluding Canva for Education).

Employees of Festival or Canva their affiliates, subsidiaries, advertising and promotion agencies, and suppliers, (together, “Employees”), and immediate family members and/or those living in the same household of Employees or Jury (as defined below) members are not eligible to participate in the contest.

HOW TO ENTER

No purchase is necessary to enter the contest. A purchase does not increase the chances of winning.

Following the conclusion of the Program, an online application form will be shared with all attendees by email. Applicants will be required to answer a series of questions regarding their intended film projects and career goals, including current project descriptions, writing samples and/or samples of previous work. Applicants will be asked to share the Canva work they completed during the Program, and ideas of how to use Canva in the future to propel their intended projects.

ENTRY MATERIALS

All entries must include the following:

  1. An official Program online entry form, properly completed.
  2. The submission of film and/or writing work samples and work made with Canva during the Program.

It is your sole responsibility to ensure that your online entry form is properly submitted. Within 24 hours of completing and submitting your online entry form, you should receive an email confirmation. If more than 24 hours have passed and you have not received an email confirmation, you may email the Festival at kickstartwithcanva@tribecafilm.com or call at 212-941-2000 to follow up. All entry materials MUST be received by the Festival by September 23, 2024 at 11:59pm ET. The Festival reserves the right to disqualify any submission, without refund of any kind, if it is not completed in accordance with these Entry Rules and Regulations.

MULTIPLE ENTRIES

Submissions are limited one entry per person. Multiple entries will result in disqualification.

JUDGING CRITERIA

Festival and Canva will designate a jury of approximately 3 - 5 design and/or entertainment industry professionals, including Festival and Canva employees (the “Jury”) to evaluate submissions. The contest is a game of skill, chance has no part in determining the winners. Projects will be evaluated based upon:

In the case of a tie, projects will be sent to a third party reviewer for additional evaluation.

PRIZES

Up to five entrants (each a “Award Winner”) will be selected to receive a Twenty Thousand United States Dollars (US$20,000) kickstart award (each a “Prize”) to be used to advance the creative, production and/or outreach components of a future film project. Award winners will be required to report on their progress to Festival every three months for one year following receipt of the Prize.

Entrants are liable for any taxes or costs incurred for receipt of any Prize.

WINNER SELECTION AND NOTIFICATION

Projects will be reviewed and deliberated on by the Jury remotely.

The Award Winners will be notified via email If an Award Winner cannot be contacted, is ineligible, fails to claim the prize within forty-eight (48) hours from the time notification was sent, or fails to timely return a completed and executed declaration and release (if required), the prize may be forfeited and an alternate Award Winner selected. Receipt by Award Winner of the prize offered in this contest is conditioned upon compliance with any and all federal, state, and local laws and regulations. To the extent permitted by law, Festival and Canva shall have no liability for any Award Winner’s failure to receive notices due to spam, junk e-mail or other security settings, Award Winner’s provision of incorrect or otherwise non-functioning contact information or any Award Winner’s inability to receive or participate in any component of the prize.

DISPUTES

This contest is governed by the laws of the United States and the State of New York, without respect to any choice of law or conflict of law principles that would result in the application of any law other than that of New York. As a condition of participating in this contest, entrants agree that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or in connection with this contest, shall be resolved individually through binding arbitration, without resort to any form of class action.

CONDITIONS OF PARTICIPATION

The contest is void where prohibited or restricted by law. All federal, state and local laws and regulations apply. By participating in the contest, each participant agrees to be bound by these official rules and the decisions of Festival and Canva, which shall be final in all respects. By participating in this contest and/or by accepting any Prize each entrant agrees to release Festival, Canva, and all entities involved in the production, sponsorship and/or promotion of the contest, or any part thereof, including each of their respective officers, directors, agents, representatives and employees; and each of these companies and individuals' respective successors, representatives and assigns (collectively, the "Released Parties") from any and all actions, claims, injury, loss or damage arising in any manner, directly or indirectly, from participation in this contest and/or acceptance or use of the prize. Each entrant warrants that (1) their submission is their own original work, (2) they have the prior informed consent of any third party individual or company featured in their submission in this Contest and (3) their project does not violate any third parties proprietary, intellectual property, privacy or publicity rights and (4) their submission does not contain any abusive, inappropriate, offensive or obscene language, imagery or content. Each Award Winner authorizes Festival, Canva and their designees to use his/her name, voice, likeness, biographical data, city and state of residence and entry materials for promotional purposes in any publicity or advertising carried out in any media, worldwide, without further payment or consideration by the Festival, Canva and/or their advertising or promotional agencies without limitation or further notification, and without providing compensation or intellectual property rights to the entrant, except where prohibited. Festival and Canva are not obligated to use any of the above-mentioned information or materials but may do so and may edit such information or materials, at their sole discretion, without further obligation or compensation. The Released Parties shall not be liable for: (a) late, lost, delayed, damaged, misdirected, incomplete, unreadable or inaccurate, entries, release forms, communications or affidavits, regardless of the method of transmission; (b) computer hardware, software or other technical or computer malfunctions, lost connections, disconnections, delays or transmission errors; (c) data corruption, theft, destruction, unauthorized access to or alteration of entry or other materials; (d) any and all losses, damages, rights, claims and actions of any kind in connection with or resulting from participation in the contest; (e) acceptance, possession, grant, or use of any Prize, including without limitation, personal injury, death and property damage arising there from; (f) claims based on intellectual property or publicity rights, defamation or invasion of privacy; or (g) any typographical, human administrative or technological errors in any materials associated with the contest. The Released Parties reserve the right to amend or waive any of these Entry Rules & Regulations, or suspend or cancel this contest at any stage, in the event of circumstances that are unforeseen or beyond their reasonable control.

CONTEST PROMOTER & PRIZE FULFILLMENT

The promoter for this competition responsible for administering this program and game of skill competition is Tribeca Enterprises LLC. Canva Pty Ltd shall be responsible for fulfillment of the Prizes.

PRIVACY POLICY

By participating in the contest, each participant acknowledges that their personal information will be collected and processed by Festival in accordance with Festival’s Privacy Policy (https://tribecafilm.com/privacy), and disclosed to Canva and processed in accordance with the Canva Privacy Policy, a copy of which is available at www.canva.com/policies/privacy-policy. Canva may collect from participants or from Festival: participant names, email address, street address, occupation and any other details participants provide in entering the contest. Festival or Canva may share your information with their group companies and trusted third-party suppliers or as otherwise detailed in their privacy policies. This may involve transferring your information to a country or jurisdiction which does not have the same data protection laws as your jurisdiction. Entrants should direct any request to access, update or correct information to Festival at kickstartwithcanva@tribecafilm.com and Canva at privacy@canva.com.
